The following terms of service outline your rights and responsibilities when using our mobile application ("App") or related services ("Services" as defined below), as well as any information, text, graphics, videos, or other types of files, materials, data, or content you create, provide, or share through the App or Services. These terms also apply to the sale of products or creation of user-contributed content (as defined below) via the App. Please carefully review our Privacy Policy, which forms part of these Terms of Service and explains how we handle your personal information.

The application and services are owned and operated by the Buzar team (“we,” “our,” or “the Company”), under Hangzhou Yuhang Nianwu Trading Firm (sole proprietorship). By accessing and using the App and Services, you agree to comply with these Terms of Service ("Terms" or "Agreement"). Please read them thoroughly before using the App or Services. If you do not agree to all the Terms, you must not access the App or use the Services. Nothing in this Agreement should be construed as granting any third-party rights or benefits.

Arbitration Notice:

Please note that these Terms include an arbitration clause. Except as specified, any disputes between you and Buzar must be resolved through mandatory and binding arbitration. Additionally, you and Buzar agree to waive the right to participate in class actions or class-wide arbitration.

1. Eligibility for Using the Services

Users under the age of 18 are not allowed to create an account or use the Services.

By using the Services, you represent and warrant that:

You can legally enter into a binding contract with Buzar.

You will comply with these Terms and all applicable local, state, national, and international laws, regulations, and rules.

Buzar’s Services are intended for individuals aged 18 and above. We do not direct our Services to minors, nor do we knowingly collect information from them. Buzar bears no responsibility for any untruthful information leading to unverified age claims. Minors are strictly prohibited from registering for or using the App and Services, even with parental or guardian approval.

2. Rights We Grant You

Buzar grants you a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable, and non-sublicensable license to access and use the Services in accordance with these Terms and our Use Policies. This license is solely for enabling you to utilize the Services as intended and to benefit from their functionality.

Our Services may automatically download and install updates, upgrades, or new features. You can adjust these automatic download settings via your device settings.

Unless expressly permitted by law or with our written consent, you are prohibited from copying, modifying, distributing, selling, renting any part of the Services, or reverse-engineering or extracting the source code of the Services’ software.

3. Rights You Grant Us

Our Services allow you to create, upload, post, send, receive, and store content. While you retain ownership of any content you submit, you grant us limited rights to use it as described below:

For all Services: You grant Buzar a worldwide, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, edit, publish, and distribute such content. This license is for operating, improving, and promoting the Services, as well as developing new Services.

For "local" services (essentially public in nature): You grant us broader permissions, including creating derivative works, promoting, exhibiting, broadcasting, publicly performing, and publicly displaying the content. You also grant us and our business partners unlimited, worldwide, and perpetual rights to use your name, likeness, or “local” content without compensation.

While we are not obligated to monitor content, we may access, review, screen, or delete content for any reason (e.g., if it violates the Terms). However, you are solely responsible for the content you create, upload, or store.

Additionally, the Services may include advertisements. By using the Services, you agree to allow Buzar, its affiliates, and partners to display advertisements within the Services.

We also welcome user feedback. By voluntarily providing suggestions or ideas, you agree that we may freely use them without compensation.

4. Content from Others

Most of the content in our Services is provided by users, publishers, or other third parties. Responsibility for this content lies solely with the individual or entity that submitted it, whether it is publicly posted or privately transmitted.

Although Buzar strives to review content and remove anything that violates our Terms, we cannot guarantee that all content complies.

We do not guarantee the accuracy, reliability, or authenticity of user-submitted content, nor do we endorse opinions expressed in it. You agree to assume full responsibility for any reliance on such content and waive any legal or equitable claims against us resulting from it.

5. Privacy

Your privacy is important to us. Please refer to our Privacy Policy to understand how Buzar handles your information when you use our Services. By using the Services, you agree to the collection, use, and transfer of your information as described in the Privacy Policy. We recommend reading it carefully.

6. Respecting the Rights of Others

Buzar respects the rights of others, and we expect the same from you. You may not upload, send, or store content that:

Violates others’ privacy, publicity, copyright, trademark, or other intellectual property rights.

Harasses, intimidates, bullies, or defames.

Contains unauthorized advertisements or spam.

Is unlawful, harmful, hateful, violent, or abusive.

Involves exploitation, violence, or harm toward minors.

Promotes illegal activities.

Contains viruses, malicious code, or harmful elements.

Collects or tracks others’ information without permission.

Attempts unauthorized access to any part of the Services.

Uses automated tools like bots to scrape or gather content.

You are also expected to respect Buzar's rights and avoid unauthorized use of:

The Services’ branding, logos, designs, or other materials.

Content from the Services for unauthorized commercial purposes.

Buzar reserves the right to:

Permanently ban accounts violating these Terms.

Remove or refuse to publish infringing content.

Access, retain, or disclose information as needed to comply with laws, enforce Terms, or protect user safety.

You acknowledge that using the Services may expose you to objectionable or inaccurate content. Buzar is not responsible for any resulting harm.

7. Respecting Copyright

You agree to only upload, post, or share content you have the legal rights to and that does not infringe on the intellectual property or privacy rights of others. Buzar respects others’ legal rights and expects users to do the same.

We comply with the Digital Millennium Copyright Act (DMCA). If infringing content is identified, we will take steps to remove it. Repeated copyright violations by a user may result in account termination.

When submitting a copyright infringement notice, you must provide the following information:

A signature of the person authorized to act on behalf of the copyright owner.

A description of the copyrighted work allegedly infringed.

Identification of the infringing content and its location on the Services.

Your contact information, including address, phone number, and email address.

A statement of good faith belief that the use of the content is unauthorized.

A declaration under penalty of perjury that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

8. Security

Buzar is committed to providing a secure environment but relies on your cooperation to achieve this. By using the Services, you agree to:

Not use the Services for unlawful or prohibited purposes.

Avoid using automated tools (bots, crawlers) to access or collect data.

Refrain from creating or using third-party applications that interact with the Services or user content without authorization.

Not interfere with other users’ experience or disrupt the functionality of the Services.

Avoid accessing others’ accounts, usernames, or passwords without permission.

Refrain from uploading harmful content like viruses or malicious code.

Not circumvent content filtering technologies or access restricted areas.

Not probe, test, or exploit the security of the Services or related systems.

Buzar retains the right to investigate and prosecute security violations, including collaboration with law enforcement. We may monitor your use of the Services to ensure compliance with these Terms or legal requirements.

9. Your Account

You are responsible for all activities under your account and must take steps to keep it secure, including:

Using a strong, unique password not shared with other accounts.

Not creating multiple accounts.

Refraining from recreating accounts after suspension or deactivation without permission.

Not selling, renting, or leasing account access.

Not sharing your password or login credentials with others.

Avoiding access to the Services via unauthorized third-party platforms.

10. Purchases and Payments

Buzar offers virtual services that can be accessed using virtual currency. These services are not owned by users but are exchanged for usage rights.

All purchase prices are displayed before a transaction, but payments are processed by third-party providers (e.g., iOS App Store or Google Play).

Sales tax may apply depending on your location.

Except as required by law, all purchases are final and non-refundable.

Virtual services may be modified or discontinued, and purchased services become void if an account is terminated.

In-App Purchases (IAP):

Offered through authorized platforms like iTunes or Google Play.

Auto-renewing subscriptions renew automatically unless canceled.

To cancel, use Buzar’s app settings or your platform account; simply deleting the app or your account will not cancel a subscription.

Refunds are generally unavailable, except for specific cases (e.g., EU users requesting refunds within 14 days).

Refund Requests:

Apple ID Users: Submit refund requests through https://getsupport.apple.com/ .

Google Play Users: Contact Google Play support and provide your order number (available in your confirmation email or Google Wallet).

Per EU regulations, users within the EU are entitled to full refunds on subscriptions within 14 days of purchase.

11. Virtual Currency

Buzar may allow users to earn virtual currency for use within the Services to access virtual goods or services. Virtual currency has no real-world monetary value and cannot be redeemed for cash or other valuable items. Terms related to virtual currency include:

Nature: Virtual currency is a personal, non-transferable, revocable license strictly for use within the Services. It does not represent ownership or property rights.

Transfer Restrictions: Virtual currency cannot be transferred or traded between accounts.

Expiration and Limitations: Virtual currency may expire or be revoked, particularly in cases of account suspension or termination. Promotional virtual currency may also expire.

Responsibility: Buzar is not liable for loss, misuse, or hacking of virtual currency. In the event of technical issues, our liability is limited to restoring the virtual currency.

Inactivity: Accounts inactive for three months may have their virtual currency frozen. Contact [joysa2tian247@gmail.com] for resolution.

Redemption: Virtual currency use is final and non-refundable. Buzar reserves the right to modify its availability, pricing, or exchange rates.

12. Data Fees and Mobile Charges

You are responsible for any mobile fees (e.g., SMS, data charges) incurred while using Buzar. If uncertain, consult your service provider.

13. Third-Party Services

If accessing or using third-party services via Buzar, you must comply with their terms. Buzar is not responsible for third-party terms or actions.

14. Service Modifications and Termination

Buzar may modify, suspend, or terminate services at any time, including:

Adding or removing features or products;

Ceasing service for certain users;

Deactivating accounts (e.g., for inactivity or misconduct).

Even if services are terminated, Sections 3, 6, 10, and 13-21 of the Terms will remain effective between you and Buzar.

15. Indemnification

To the extent permitted by law, you agree to indemnify Buzar and its affiliates against all claims or damages arising from:

Your use of the services;

Your content;

Your violation of the Terms.

16. Disclaimer

Buzar provides services "as-is" and "as available" without any guarantees, including but not limited to security, error-free operation, timeliness, or accuracy. Buzar is not responsible for any content encountered within the services, including unlawful, misleading, or inappropriate content.

17. Limitation of Liability

To the extent permitted by law, Buzar and its affiliates are not liable for any indirect, incidental, special, or consequential damages, including but not limited to:

Your inability to access or use the services;

Actions or content of third parties;

Unauthorized access to or alteration of your content.

18. Arbitration, Class Action Waiver, and Jury Trial Waiver

Buzar's arbitration provisions outline how disputes will be resolved, as follows:

Arbitrator Authority: The arbitrator has the same authority as a judge to grant relief based on individual circumstances, and their decisions are final and binding.

Class Action Waiver: All disputes must be arbitrated or litigated individually and cannot be combined with others' claims. If this clause is deemed invalid, neither party may demand arbitration.

Confidentiality: Arbitration proceedings and all submitted evidence are confidential unless both parties agree in writing or disclosure is required by law.

Waiver of Rights: Any rights under the arbitration provision may be waived by the responding party, but this does not affect the validity of other parts.

Opt-Out Option: Users may opt out of arbitration within 30 days of first being bound by the agreement by sending a written notice including their name, address, username, registered email, and a statement opting out.

Small Claims Court: Either party may pursue individual claims in small claims court.

Survivability: The arbitration agreement remains valid even if the relationship between the user and Buzar ends.

19. Governing Law

These Terms and related disputes, including tort claims, are governed by U.S. law, excluding conflict of law principles.

20. Severability

If any provision of these Terms is found to be unenforceable, it will be severed, and the remaining provisions will remain effective.

21. Additional Terms for Specific Services

Certain services may include additional terms and conditions. By using such services, you agree to those additional terms, which form part of the overall agreement.

22. Final Terms

Entire Agreement: These Terms constitute the entire agreement between you and Buzar, superseding any prior agreements.

No Third-Party Rights: These Terms do not grant rights to any third parties.

Enforcement of Terms: Failure to enforce any provision does not waive it.

Reservation of Rights: Any rights not expressly granted to you are reserved by Buzar.

Non-Transferable: You may not transfer your rights or obligations under these Terms without prior consent.

Language Version: The English version of the Terms prevails in case of conflict with translated versions.
